US to ask court to nullify ruling against oil profit tax

The Justice Department announced it will ask the Supreme Court to set aside a ruling declaring the windfall oil profits tax unconstitutional.
The government's decision to appeal had been expected after US District Judge Ewing Kerr's ruling Nov. 4 that the tax, imposed under the Carter administration , is invalid because it exempts Alaskan oil and thus is not applied uniformly to all states.
