Order delayed for counsel in Carter brief papers case

A federal appeals court temporarily set aside an order Friday that woudl force Attorney General William French Smith to appoint an independent counsel to investigate how the 1980 Reagan campaign obtained breifing papers from Jimmy Carter's White House.

The three-judge appeals-court panel said Smith does not have to comply with US DIstrict Judge Harold H. Greene's order until further word from the appeals court. The order was issued after the appeals-court panel received an emergency request from the Justict Department to sidetrack Judge Greene's order.
